Lowell is a dedicated member of Orrick's Energy and Infrastructure team, specializing in renewable energy development and decarbonization strategies on both the buy- and sell-side of transactions.

Lowell's practice centers on drafting and negotiating a wide range of documents related to renewable energy project development, including power purchase agreements (PPAs), virtual PPAs, energy storage service agreements, tolling agreements, and engineering, procurement, and construction contracts. He also supports clients with interconnection, transmission, and regulatory matters. Leveraging his regulatory and appellate expertise, Lowell delivers comprehensive, forward-thinking advice to help clients anticipate and overcome obstacles.  

Before joining Orrick, Lowell served as a junior partner at a boutique law firm where he led the representation of developers of solar, wind, hydroelectric, generation-plus-storage, and biomass projects. His work involved negotiating offtake agreements, navigating complex regulatory environments before state utility commissions and the Federal Energy Regulatory Commission, and engaging in extensive appellate practice related to renewable energy project development under the Public Utility Regulatory Policies Act.

Prior to practicing law, he served as a climate policy analyst for an international non-governmental organization in Washington, D.C., where he advanced U.S. climate policy on refrigerants and contributed to amending the Montreal Protocol to phase-out hydrofluorocarbon super greenhouse gases.  

  • Lowell's representative experience includes:
    • Representation of leading project developers of gigawatts of utility-scale solar, wind, stand-alone storage, co-located generation and storage projects, and other innovative energy projects in negotiations of power purchase agreements, tolling agreements, resource adequacy confirmations, and related offtake arrangements with a variety of buyers, including investor-owned utilities, California Community Choice Aggregators (CCAs), corporate offtakers, hedge providers, and others across the United States and globally.
    • Representation of the project developer in negotiating various offtake arrangements for a gigawatt-scale solar-plus-storage facility that will be the world’s largest project of its kind.
    • Representation of market-leading entities in the development and procurement of gigawatt-scale islanded power systems for data center projects, including structuring and negotiating complex, first-of-a-kind energy supply, transport, and purchase arrangements to ensure reliable, resilient, and sustainable power solutions tailored to the unique operational needs of large-scale data centers.
    • Representation of corporate buyers related to asset management of existing renewable energy purchase agreements.

    • Early-stage project development support related to small modular nuclear reactor projects.

    • Support for leading project developers regarding contract administration and dispute resolution related to existing renewable energy projects.

    • Representation of project developers in engineering, procurement, and construction (EPC) related agreements regarding the purchase of major transmission and interconnection facility equipment for multiple projects across the United States.
