Orrick Obtains Dismissal of Unpaid Wages Class Action on Behalf of Williams-Sonoma

On July, 29, 2016, Los Angeles Superior Court Judge John Shepard Wiley dismissed a putative class action concerning unpaid wages against Orrick client Williams-Sonoma.

Plaintiff Harley Shine alleged that retailer Williams-Sonoma and its other brands, including Pottery Barn, Pottery Barn Kids, West Elm and Rejuvenation, owed its retail store employees wages for time that employees spent calling in to see if they were needed for “on-call” shifts. However, Judge Wiley was “persuaded completely” by the Orrick team’s argument that because Shine was a class member in another unpaid wages suit against Williams-Sonoma that settled last year, this suit should be dismissed.

The Orrick team representing Williams-Sonoma was led by employment partner Jessica Perry and included associates Allison Riechert Giese, Rachel Wainer Apter and Randall Smith.
