China Business Law Journal released its “Deals of the Year 2018” report recognizing outstanding China-related deals and cases in 2018. Chinese state-owned enterprise Advanced Technology & Materials (AT&M)’s U.S. trade secret misappropriation case, handled by Orrick, was named a “Disputes and Investigations Deal of the Year.”
Orrick achieved a complete victory in the ITC investigation relating to alleged trade secrets misappropriation involving amorphous metal on behalf of AT&M and four other Chinese respondents when the complainants, Hitachi Metals and its U.S. subsidiary Metglas, unilaterally moved to terminate the investigation at the close of fact discovery, without any concession or settlement agreement.
The Orrick team’s innovative approach to the case focused on combating the deficiencies in the complainants’ allegations of misappropriation, including destroying the evidence from the undercover sting operation. This is one of the very few, if not the only known trade secret case that a Chinese corporate respondent has won before the ITC.
