Congratulations to Orrick partners Lynne Hermle and Josh Rosenkranz on being named to Law360’s list of MVPs for 2018. The publication recognized Lynne and Josh among the nation’s lawyers who have “distinguished themselves from their peers by securing hard-earned successes in high-stakes litigation, complex global matters and record-breaking deals.”
Lynne was named an employment MVP while Josh was recognized as an appellate MVP. It is the fourth time Lynne and Josh have been named MVPs since Law360 established the list in 2011.
In this Q&A, Josh discusses two of his signature wins of the past year -- a Federal Circuit ruling that reinstated Oracle’s $8 billion copyright infringement case against Google and a U.S. Supreme Court decision in Sessions v. Dimaya providing important protections to immigrants in deportation proceedings. Josh also offered important advice to young lawyers going into appellate law, stressing the importance of finding ways to argue cases in court (Josh did so early in his career as a public defender) and honing your writing skills.
“Good legal writing is not different from good writing,” Josh told Law360. “Your job as an appellate lawyer, when it comes to the written brief, is to engage the audience and make them want to keep reading, make everything seem accessible.”
The profile of Lynne describes her as a “serial winner” who has been a “go-to employment lawyer in Silicon Valley for decades.” Law360 highlighted Lynne’s wins this year for Microsoft and Twitter, turning away bids to certify nationwide class actions in closely-watched gender discrimination case. Lynne’s advice to young attorneys: “Don’t take it personally … The conflicts, the disputes, the fighting are not personal. If you are an emotional, competitive person, it’s very easy to get caught up in the disputes. Don’t do that. It’s not about you.”
