Webcast: Managing the Commerce Department’s New Circumvention Case and Solar Tariffs

On March 28th, the U.S. Commerce Department announced a "circumvention inquiry" against all solar panels made in Cambodia, Malaysia, Thailand and Vietnam that incorporate Chinese materials, the result of which could be large new duties on imports of those panels. Commerce will solicit questionnaires from certain Cambodian, Malaysian, Thai and Vietnamese producers concerning their export of PV modules and cells to the United States and will issue a preliminary circumvention determination in late August 2022 and final determination in early 2023. The announcement raises numerous questions and presents significant challenges surrounding manufacturing costs and profitability amid a sea of uncertainty, all at a time when many are still struggling to address COVID and supply chain disruptions.
