Orrick Attorneys Author Article on Statute of Limitations for Absent Class Members

Orrick’s Jim Kramer, Alex Talarides and Michael Wood authored a Daily Journal article that discusses the statute of limitations for absent class members in class actions. They pointed to “the Supreme Court’s decision in Resh v. China Agritech which could have a profound impact on class actions – particularly in the 1st, 2nd, 3rd, 5th, 8th and 11th Circuits where American Pipe & Construction Co. v. Utah is interpreted narrowly.” The authors noted that “those circuits could see a clear increase in successive class actions should the Court reverse sometimes decades-old circuit precedent.”
