Energy Trade Update: Supreme Court Tariff Ruling

On Friday, February 27 Orrick hosted a webinar examining the U.S. Supreme Court’s decision to invalidate tariffs purportedly imposed under the International Emergency Economic Powers Act (IEEPA). The lifting of these tariffs will greatly benefit sourcing of equipment for energy projects. By the same token, it raises thorny questions regarding refunding of tariffs paid. In general, equipment suppliers have the most immediate concerns about tariff refunds since they generally import equipment for energy projects. At the same time, developers have acute interests in refunds as sourcing pricing terms often depend on tariff costs.

Our discussion focused on the key points of the Supreme Court’s ruling, the implications for energy project development and investment and provided practical insights on managing costs, supply chain impacts and compliance considerations for industry stakeholders.
