For a remarkable third time in 2016, The American Lawyer recognized Josh Rosenkranz as “Litigator of the Week” for securing a federal appeals court victory on behalf of Microsoft in one of the most closely-watched cases of the year. They detail Josh’s accomplishment, describing how he has developed “a reputation for meticulous oral argument preparation and the ability to craft creative – even downright literary – legal briefs.”

In naming Josh “Litigator of the Week” for his work for Microsoft, American Lawyer notes that he has “handled plenty of high-profile appeals” as head of the firm’s U.S. Supreme Court and Appellate practice. Surprising experts who doubted his chances, Josh persuaded the Second Circuit U.S. Court of Appeals on July 14 to reject the U.S. Justice Department’s efforts to execute a search warrant for email data stored on a Microsoft server in Ireland, overturning a lower court order in the government’s favor.

With dozens of tech industry leaders and other organizations aligned with Microsoft, the case attracted attention across the world, from The New York Times and Wall Street Journal to The Guardian and Agence France Presse. Underscoring the important issues in the case, the Microsoft win was reported by more than 350 media outlets within the first 48 hours, reaching an estimated 862,000 viewers in the U.S. and 1.5 billion globally.
