Deutsch: Aktuelle Entwicklungen im Bereich der Data Privacy Litigation

In the current edition of the German law journal Betriebs-Berater (9/2023), Daniel Ashkar and Christian Schröder discuss current and upcoming developments in the data privacy litigation field in Germany and the European Union.

These include the prominent wave of Google Fonts cease and desist letters which affected a significant number of companies in Germany. In this context, the article includes remarks on particularities regarding cease and desist letters in the data privacy field as well as recommendations for companies on how to reduce the risk of becoming a target for such letters or complaints.

Additionally, the article covers the current state regarding the implementation of the EU Directive on representative actions for the protection of the collective interests of consumers into German law including related implications for data privacy litigation.

Furthermore, upcoming landmark judgments from the Court of Justice of the European Union in the data privacy litigation field in relation to immaterial damage claims and the ability of companies to take legal actions against their competitors for alleged data privacy law violations are discussed.
