The Impact of Schrems II and Threat of Data Localization | ADCG Podcast: Ep. 14

Association for Data and Cyber Governance
38 minute listen | January.27.2021

In July 2020, the Court of Justice of the European Union affirmed that international data flows under the EU's data protection regime, the GDPR, will continue to be based on EU Standard Contractual Clauses, while the EU-U.S. Privacy Shield remains invalid. What are the implications of the Schrems II decision and its interpretation and implementation by the European Data Protection Board?  Would the U.S. negotiating hand be strengthened by enactment of national privacy legislation?  Series hosts Jerry Buckley and Jody Westby discuss this with Peter Swire, Professor of Law and Ethics at the Georgia Tech's Scheller College of Business, and Senior Counsel at Alston & Bird LLP.
