Our Düsseldorf based Cyber and Data Privacy Assistant Tobias Lantwin recently published a well-recognized article on the risk profile of the German data protection officer.

When the EU’s General Data Protection Regulation (GDPR) comes into force on 25. May, for the first time company Data Protection Officers (DPOs) attain a prominent position in all EU member states. For many companies, DPOs will then play an important role as part of their data protection compliance.

In Germany however, the discussion seems to be particularly focused on the liability of the company DPO, driven by the fear of an escalating liability. Though, as Tobias lays out in his article, compared to the current legal situation, the provisions of the GDPR are not drafted to scare off DPOs.
