For more than 30 years, Kyle has represented project and corporate credits in all major types of financings. These transactions include SEC registered and 144A/Reg S debt capital markets issuances, debt private placements, private credit loans, term and revolving credit facilities, lease financings and tax-exempt offerings.
Kyle has counseled a wide range of participants in the nuclear sector, including owners of utility-scale generating facilities, corporate offtakers and new market entrants. Leveraging Orrick's leading technology practice, he has advised companies in optimizing capital structures to support future small modular reactor (SMR) development.
Kyle's practice also includes the representation of clients seeking and obtaining substantial non-dilutive funding from the U.S. government, including billions of dollars of loan guarantees from the U.S. Department of Energy (DOE) Energy Dominance Financing (formerly the Loan Programs Office (LPO)) and the U.S.D.A. Rural Utilities Service.
He has extensive experience in the development and structuring of long-term power purchase and tolling agreements with respect to thermal (nuclear, natural gas and coal) and renewable generation facilities. He has also represented clients in mergers and acquisitions, auctions, joint ventures, corporate restructurings and other general corporate matters.
