Employment law partner Mike Delikat discussed a recent speech by SEC chair Mary Jo White, in which she emphasized that employees who repeatedly raised concerns internally need to be taken seriously, in an article in The Wall Street Journal.

Noting that a company can potentially take disciplinary action when an employee is found to be making complaints in bad faith, Mr. Delikat said: "Companies walk a fine line when they want to take action against someone they believe has made a claim in bad faith – they could open themselves up to a retaliation charge."

Mr. Delikat is Chair of Orrick’s Global Employment Law Practice and is the founder of the firm’s Whistleblower Task Force.
