Employment Partner Discusses Dodd-Frank Ruling

Employment law partner Mike Delikat recently spoke with Law360 about the implications of a New York federal judge's ruling that the Dodd-Frank Act's whistleblower provision doesn't apply to conduct outside the U.S.

Delikat stated that, “This was an important win for employers in that it limits the number of individuals who can bring retaliation claims under Dodd-Frank in the U.S. federal courts.”

“However, the possibility that the SEC could still bring an enforcement action against a company that retaliated, even against a non-U.S. citizen — and also the cash bounty incentive for non-U.S. citizens to provide tips to the SEC — is still there,” he added.
