Orrick's Josh Rosenkranz Again Named AmLaw Litigator of the Week

The American Lawyer
May.27.2016

For the second time this year, Orrick partner E. Joshua Rosenkranz has earned The American Lawyer’sLitigator of the Week” honor. This time AmLaw recognized his role in securing a major appellate win in the Countrywide “Hustle” case out of New York. Rosenkranz, head of Orrick’s U.S. Supreme Court & Appellate team, was selected along with Williams & Connolly partner Kannon Shanmugam for their work in persuading the 2nd Circuit U.S. Court of Appeals to overturn the federal government’s fraud action against Bank of America, Countrywide Financial and former Countrywide executive Rebecca Mairone.

Rosenkranz represented Ms. Mairone, while Shanmugam was counsel for Bank of America.

The 2nd Circuit ruling on May 23 overturned a $1.27 billion verdict against Bank of America over the “Hustle” mortgage program run by Countryside, as well as a liability finding against Mairone, who had been ordered to pay a crushing and career ending $1 million civil penalty.

As Rosenkranz told AmLaw, “You have to tell a powerful story, especially when you are representing a vilified client or a vilified industry—a compelling story that presses the reset button.”

In addition to Rosenkranz, the Orrick team was made up of Kelsi Corkran, Bob Loeb, Danny Rubens, Sarah Sternlieb and former associate Alec Orenstein. Bracewell also served as co-counsel in representing Ms. Mairone.
