Japanese Companies in US Courts: A Year in Review

Orrick’s Tokyo Office Litigation Group is hosting a series of monthly “Orrick Library” seminars to explore legal issues in various fields in Japan as well as the United States, Asia and Europe. The next seminar will be presented live by Robert Reznick, partner in the Complex Litigation and Dispute Resolution Group of Orrick’s Washington D.C. office and Managing Editor of The World in US Courts: Orrick’s Quarterly Review of Decision Applying US Law to Global Business and Cross-Border Activities, and Shinsuke Yakura, partner in the Complex Litigation and Dispute Resolution Group of the Tokyo office  in Osaka, on Monday October 23, and in Tokyo, on Tuesday, October 24.

The seminars will address the topic, Japanese Companies in US Courts:  A Year in Review, and will discuss recent judicial decisions in which Japanese companies tried to win dismissal from US litigation on grounds that US law did not apply to the global conduct alleged or that the court could not assert “personal jurisdiction” over the companies because their contacts with the US were too remote. The presentation will focus on the facts of these cases and the analysis used by the judges in reaching their decisions as well as the strategic measures Japanese companies should take before and/or after their involvement in a litigation in the US.

There will be set aside for questions and answers.

Robert Reznick Senior Counsel

Washington, D.C.

He currently is national coordinating counsel for a major oil company in connection with its climate change litigation. He previously served as co-lead counsel to a major international pharmaceutical manufacturer in the defense of nationwide litigation challenging industry pricing practices.

Rob’s experience includes extensive work in antitrust and False Claims Act cases, claims alleging fraud, and agency enforcement actions. His pharmaceutical industry activities include service as outside counsel to and Corporate Secretary of the Pharmaceutical Security Institute, Inc., the industry’s not-for-profit trade organization dedicated to the fight against pharmaceutical counterfeiting.

He is Managing Editor of The World in U.S. Courts, Orrick’s quarterly review of court decisions addressing personal jurisdiction over non-U.S. parties and the extraterritorial application of U.S. law to global business and cross-border activities.

Rob also served two terms on the District of Columbia Bar’s Pro Bono standing committee. Before joining Orrick, he was a partner in Hughes Hubbard & Reed LLP and Clifford & Warnke, in Washington, D.C.
