Laura Najemy is an experienced trial lawyer who strives to find creative and innovative solutions to her clients’ most complex legal problems. Her practice focuses on trademark, copyright, trade secret, false advertising, and design patent disputes in the tech and consumer product space.

Laura’s litigation experience spans the gamut from initial pleadings through trial and everything in between. She represents numerous clients in the technology, automotive, retail, consumer products, and real estate industries. Her clients appreciate her diligence, effective communication, and excellent strategic judgment. At Orrick, Laura leads the Women’s Initiative for the Boston office and co-chairs the firm’s Middle East & North African affinity group. She also co-chairs the Boston Bar Association’s Intellectual Property section.

Laura served as a Special District Attorney for Middlesex County in 2014. In that capacity, she prosecuted felony and misdemeanor criminal cases, trying jury and bench trials to final verdict and arguing dispositive and evidentiary motions. In 2010–2011, Laura completed a yearlong fellowship at the Political Asylum/Immigration Representation (PAIR) Project in Boston, where she assisted individuals who were affirmatively seeking asylum as well as defended individuals who were in removal proceedings in front of the Immigration Court. Through her pro bono practice, Laura continues to be committed to working to help individuals with various immigration matters.

    • Represents Williams-Sonoma in a design patent and false advertising case adverse to online retailer Wayfair relating to claims that concern Wayfair’s unauthorized copying of the client’s patented furniture designs and false and misleading statements regarding the origins of its designs.
    • Represented Pradera SFR, a subsidiary of Bristol Group, in a copyright litigation matter concerning the design of single-family residences in a built-for-rent development in Texas .
    • Represents Central Garden & Pet Company in a remand trial focusing on head-start damages for a claim of misappropriation of ideas. The Federal Circuit remanded the case to the district court for a trial solely regarding an assessment of head-start damages relating to Central Garden’s alleged use of the plaintiffs’ idea for an applicator device to be used in connection with its topical flea & tick medication.
    • Represents New Balance in a purported class action concerning “Made in the USA” marketing.
    • Represented Mahindra in an ITC investigation concerning trademark and trade dress claims brought by FCA US LLC related to the design of the Jeep Wrangler. Represents Mahindra in a related district court litigation in the Eastern District of Michigan.
    • Successfully defended ConsenSys in trade secret misappropriation litigation brought by BlockCrushr, Inc. in the Eastern District of New York.
    • Represented Locast, an over-the-air broadcast platform, in copyright litigation brought by the major television networks.
    • Represented Advice Interactive Group against Web Group, Inc. in copyright infringement and trade secret misappropriation case concerning online visibility reporting.
    • Represented Aereo, a provider of remote antenna and RS-DVR technology platform, in multi-district copyright litigation brought by the major television networks alleging violation of their “public performance” rights.
