Clem is the leader of Orrick’s Intellectual Property practice. His practice focuses on intellectual property litigation and on complex commercial cases with a high-technology component. He has successfully tried a wide variety of civil and criminal cases to verdict in state and federal courts and in arbitration.

Clem has been recognized in a variety of publications, including the Daily Journal’s list of California’s top 75 IP Litigators in California. In the latest Chambers USA rankings, clients note he is a “very persuasive advocate who knows the law inside out and is able to get to the heart of the issue very quickly." Managing Intellectual Property described him as a “highly respected litigator in the California IP market and beyond.” Intellectual Asset Management’s Patent 1000 notes he is a “commercially savvy first-chair trial lawyer,” a “tenacious, pragmatic litigator who excels at finding innovative solutions,” “one of the best writers anywhere” and a “fantastic negotiator.”

Clem’s current clients include Sonos, Zynga, RingCentral, Checkpoint, HCW, Roblox and Zendrive.

Clem graduated with honors from both Harvard Law School and from Harvard College. He lives in Marin and spends his free time cycling around Mt. Tam.

    • Sonos v. Google: On behalf of Sonos, we filed a patent infringement suit against Google in US District Court for the Central District of California and the ITC. The litigation concerns five patents covering multi-room audio technology.
    • Finjan v. Check Point Software Technologies: We are defending Check Point from a high stakes, multi-patent case.
    • PurePredictive v. H2Oai: San Francisco AI-provider H20.ai was sued by competitor Purepredicitive Inc, for patent infringement in the Federal District Court of Northern California. We invalidated the patent on a motion to dismiss, and currently represent H20.ai in the Federal Circuit.
