Employment litigator Kayla Delgado Grundy blends creativity and tenacity to fiercely protect her clients.

Companies are often unwittingly out of compliance, particularly those which operate in states such as California, which have rapidly evolving, employee-friendly regulations. To prevent individual discrimination or harassment allegations from spiraling into class actions, Kayla finds innovative solutions to quickly and quietly resolve such matters. She applies that same finesse when handling highly sensitive trade secret matters, which also require quick and decisive action to preserve her client’s reputation.  

In addition to resolving problems before they escalate, Kayla also helps clients succeed in litigation when necessary. Undaunted by opposing counsel, government agencies or difficult fact patterns, she successfully defends clients from a variety of employment claims in state and federal court. Kayla has particular expertise in defending against large-scale class actions, including those based on systemic discrimination and pay equity claims or on wage and hour claims.

Kayla has an active pro bono practice where she counsels local non-profit organizations and helps navigate difficult employment issues so that the leaders of those organizations can focus on fulfilling their purpose and providing services to the community.

  • Kayla's notable engagements include the following.

    • Represents Workday in nationwide employment class action involving allegations of systemic discrimination based on its development of alleged artificial intelligence based screening tools.
    • Represents large technology company in defending against allegations of statewide violations of the California Equal Pay Act.
    • Represents technology and medical device companies, among others, in investigations by government agencies including the EEOC, OFCCP, and California CRD.
    • Represented Oracle America, Inc. through trial in a high-stakes case against the OFCCP involving allegations of systemic compensation and job assignment discrimination that resulted in a complete dismissal of all claims.
    • Represented Oracle America, Inc. in a statewide pay equity class action under the California Equal Pay Act and successfully obtained decertification of the class.
    • Represented a financial services company in gender discrimination class action which successfully resolved at settlement.
    • Represented Bank of the West in a statewide wage and hour class action and successfully defended against class certification.
    • Represented a technology company in defending against a statewide wage and hour class action including joint employer allegations.
    • Represented two subsidiaries of Williams-Sonoma, Inc. in successfully obtaining a preliminary injunction against a former executive and his new employer in a trade secrets action.
    • Represented an individual defendant against allegations of trade secrets misappropriation through trial where plaintiff's recovery was limited to less than four percent of the claimed $25M in damages.
    • Represented Oracle America, Inc. in defending against a $6.6 billion breach of contract, fraud, false claims act, and civil RICO claims. The matter resolved very favorably to Oracle.
