Seth Harrington is an experienced litigator who focuses on defending clients against class action litigation and regulatory investigations that arise in connection with a cybersecurity incident or data privacy matter. Clients turn to Seth to help navigate the wide array of legal issues that arise in the response to and investigation of an incident, having represented companies in connection with some of the most significant cybersecurity breaches involving consumer information.

When confronted with a cybersecurity incident, companies call on Seth to advise on incident response and crisis management in anticipation of litigation. Leveraging his years of experience leading forensic investigations and defending clients in litigation, Seth also advises clients on cyber insurance and the Payment Card Industry Data Security Standard.

Seth also defends clients in connection with litigation in class action and other litigation, including insurance and commercial disputes.
    • Arby’s Restaurant Group. Represents Arby’s Restaurant Group in defending against class action litigation and in litigation with its processor arising from a data security incident announced in February 2017.
    • Hilton Worldwide. Representing Hilton Worldwide in litigation against Hilton's former payment card processor in connection with a commercial dispute relating to two separate data security incidents that affected certain Hilton-branded hotels around the world in 2014 and 2015.
    • Sally Beauty. Lead counsel for Sally Beauty in litigation against Visa Inc. seeking recovery of assessments imposed by Visa and collected from Sally Beauty.
    • Landry’s Inc. Representing Landry’s Inc. in litigation against Visa and MasterCard in connection with a data security incident announced in December 2015.
    • Supervalu Inc. Defended Supervalu Inc. from claims, litigation and regulatory inquiries arising out of data security incidents announced in August 2014.
    • The Home Depot. Advised The Home Depot in connection with card brand inquiries arising out of the data security incident announced in September 2014.
    • The Aldo Group Inc. Represented Aldo in the defense of card brand claims in connection with data security breach discovered in 2010 and in connection with litigation against MasterCard and Aldo’s processor regarding penalties imposed by MasterCard and collected from Aldo by the processor.
    • Genesco Inc. Represented Genesco in the defense of card brand claims in connection with data security breach announced in 2010, including litigation against Visa seeking recovery of fines and assessments imposed by Visa and collected from Genesco by Genesco’s acquiring banks.
    • Heartland Payment Systems Inc. Represented Heartland in the defense of various legal challenges stemming from the data security breach announced in 2009, including class action litigation brought on behalf of a putative class of all financial institutions in the United States.
    • The TJX Companies Inc. Represented TJX in the defense of card brand claims and financial institution class action arising out of the data security breach announced in 2007.
    • Wyndham Hotels & Resorts. Represented Wyndham in the defense of card brand claims related to data security breaches suffered by certain of the Wyndham-branded hotels in 2008-2010.
