Orrick’s Rich Martinelli is featured in a Law.com Skilled in the Art panel discussing the USPTO’s questions on patenting artificial intelligence inventions. In discussing whether patent laws would need to be revised where an entity other than a natural person contributed to the conception of an invention, Rich noted, “Accepting inventions made by AI systems would actually require a fundamental re-think of our entire patent system. And since the whole point of AI is as a tool to solve hard problems more easily, we cannot guarantee that the economic balance struck by the patent system is fair for AI-created inventions.”
