Mark Jansen is a trademark and brand partner in Orrick’s New York office, where he helps lead the firm’s trademark efforts. He represents companies ranging from startups and emerging businesses to Fortune 100 companies across a broad range of intellectual property matters, with a focus on brand strategy and global brand launches, high-stakes brand acquisitions, trademark disputes, litigation strategy and enforcement, and the trademark and brand aspects of mergers and acquisitions.

Mark helps companies at the frontier of technology launch new brands, build global portfolios and grow into household names. He advises on the brand decisions that shape their businesses, from naming strategy and global clearance to building, managing and protecting international trademark portfolios. He handles high-stakes brand acquisitions, securing third-party trademarks and domain names so clients can launch and rebrand under the names they want. Working directly with CEOs, founders, CMOs and general counsel, he provides commercially focused advice on brand development, trademark protection and the strategic management of valuable brand assets. His clients span AI, enterprise software, hardware, consumer technology and e-commerce, gaming, virtual and augmented reality, autonomous vehicles and robotics, space and defense technology, blockchain and other emerging industries. He also regularly advises internet and social media platforms on trademark and brand protection matters.

He has extensive experience handling complex, high-stakes trademark disputes. He advises clients on pre-litigation strategy, infringement claims, cease-and-desist letters and settlement negotiations. His work also includes opposition and cancellation proceedings before the Trademark Trial and Appeal Board (TTAB), multijurisdictional trademark conflicts, domain name disputes, including cybersquatting claims under the Anticybersquatting Consumer Protection Act (ACPA), and anti-counterfeiting enforcement. He develops strategies designed to protect clients’ brands, resolve conflicts and minimize business disruption. He also negotiates coexistence agreements that support product launches, market expansion and broader business objectives.

Mark regularly advises on the trademark and brand aspects of mergers and acquisitions, including intellectual property due diligence, trademark portfolio reviews, risk assessment, IP integration and post-transaction brand strategy. His transactional experience also includes complex intellectual property acquisitions and licensing, helping clients identify, value, acquire and protect the brand assets central to their business and growth strategies.

He brings a technology-forward approach to trademark practice and is helping modernize how Orrick delivers trademark services, pairing experienced legal judgment with modern technology across clearance, portfolio management and enforcement.

Mark is recognized for his trademark work by Chambers USA, World Trademark Review 1000, The Legal 500 and Lawdragon, and has twice been shortlisted for Managing IP’s U.S. Trademark Practitioner of the Year (2023 and 2025), among other accolades.
