Robert Taylor is a member of Orrick’s Antitrust Litigation practice group with broad experience litigating high-stakes complex antitrust matters and providing antitrust and litigation counseling in a variety of industries, including in the pharmaceutical and life sciences, software and technology, broadcasting, publishing, and real estate spaces.

A veteran antitrust litigator, Rob has litigated and counseled on high-profile antitrust matters on behalf of leading companies in a wide range of sectors, including litigated merger challenges, putative antitrust class actions, government antitrust investigations, and private actions against competitors. He has successfully litigated cutting-edge competition matters, including defending against allegations of algorithmic collusion and price-fixing through the use of software.

From late 2018 through early 2019, Rob completed a secondment at the litigation department of a major media company.

Rob maintains an active pro bono practice, where his work has focused primarily on benefits applications and appeals for low-income disabled veterans.

Prior to joining Orrick, Rob was an active-duty Army JAG officer, where he served as a Special Assistant U.S. Attorney, an administrative law attorney, and a special victims counsel, among other roles. As a Special Assistant U.S. Attorney, he first-chaired more than 10 trials in federal court, including two jury trials.

    • FTC v. Tempur Sealy International, Inc. and Mattress Firm Group Inc., No. 4:24-cv-2508 (S.D. Tex.) – representednon-party Serta Simmons Bedding, LLC in the FTC’s challenge to the proposed transaction.
    • FTC v. IQVIA Holdings Inc. and Propel Media, Inc., No. 1:23-cv-6188 (S.D.N.Y.) – represented IQVIA Holdings Inc. in the FTC’s challenge to IQVIA’s proposed acquisition of Propel Media, Inc.

    Putative Antitrust Class Actions

    • In Re Amazon.com, Inc. eBook Antitrust Litigation, No. 1:21-cv-351 (S.D.N.Y.) – represented Simon & Schuster, LLC in defending against claims that Simon & Schuster conspired with other major book publishers and Amazon to unreasonably restrain trade through their eBook sale and distribution agreements, resulting in a complete dismissal of Simon & Schuster from the action.
    • Bookends & Beginnings LLC v. Amazon.com, Inc. et al., No. 1:21-cv-2584 (S.D.N.Y.) – represented Simon & Schuster, LLC in defending against claims of unlawful price discrimination under the Robinson-Patman Act, resulting in a complete dismissal of the action.
    • In Re: RealPage, Inc., Rental Software Antitrust Litigation, No. 3:23-md-3071 (M.D. Tenn.) – represented Brookfield Properties Multifamily LLC in a complex putative class action involving allegations of algorithmic collusion and price-fixing through the use of revenue management software.
    • In Re: Local TV Advertising Antitrust Litigation, No. 1:18-cv-6785 (N.D. Ill.) – represented Paramount Global in connection with allegations of an unlawful conspiracy among TV station owners to fix prices of broadcast TV spot advertising through anticompetitive information exchanges.
    • Masiello v. Arizona Association of Realtors, et al., No. 2:24-cv-45 (D. Ariz.) – represented state association of realtors in connection with allegations that realtor commission rules forced home sellers to pay excessive fees.

    Competitor Actions and Other Private Antitrust Litigation

    • FuboTV Inc. et al. v. The Walt Disney Company et al., No. 1:24-cv-1363 (S.D.N.Y.) – represented Warner Bros. Discovery, Inc. in an antitrust challenge to the proposed formation of a joint venture to launch a sports-focused streaming service.
    • In Re: EpiPen (Epinephrine Injection, USP) Marketing, Sales Practices and Antitrust Litigation, No. 2:17-md-2785 (D. Kan.) – represented Sanofi-Aventis U.S. LLC in bringing monopolization claims against a pharmaceutical industry competitor.
