  David has represented a broad range of clients across industries in various intellectual property and commercial dispute litigations. Some of his recent engagements include:

  • United States v. Ding (N.D. Cal) - Represented the defendant in a high-profile trade secrets and economic espionage trial.  Argued several critical pre-trial and post-trial motions, and cross-examined several key fact and expert witnesses at trial.
  • Commure Inc. v. Canopy Works, Inc. (N.D. Cal) - Represented counterclaimant Canopy Works, Inc. in a bet-the-company trade secret, Lanham Act and business torts litigation in the Northern District of California.  Successfully secured preliminary injunctive relief in the District Court and defeated preliminary challenges in the Ninth Circuit Court of Appeals, ultimately resulting in a favorable settlement.
  • Fellow Industries v. Turlyn International, et al. (N.D. Cal) - Represented Fellow Industries -- a premium, globally-recognized kettle and kitchenware brand -- in a design patent and trade dress enforcement action against manufacturers of allegedly infringing kettles.  Secured permanent injunctive relief through a court-enforced settlement, protecting the iconic design of Fellow's acclaimed goose-neck kettles. 
  • AC Management v. Courier Plus d/b/a Dutchie (D. Ariz) - Represented counterclaimant Dutchie -- a nationally recognized software company in the cannabis space -- in a trademark and business torts litigation against an alleged infringer of Dutchie's trademarks.  Secured a successful settlement, which protected Dutchie's use of its trademarks and brandings. 
  • HotSpot Therapeutics, Inc. v. Nurix Therapeutics, Inc. (N.D. Cal) - Represented Plaintiff HotSpot Therapeutics in a trade secret misappropriation ligation involving cutting-edge allosteric drug discovery technology.  
  • HD Silicon Solutions v. Microchip Technology (N.D. Cal) - Represented a leading semiconductor manufacturer in a multiyear patent infringement litigation. 
  • Achieved a complete defense victory on behalf of a leading growth equity and venture capital firm in an earnout dispute in front of the American Arbitration Association.
  • Represented a leading website design company in various copyright disputes across the country. 
  • Represented a global investment firm in a trade secret misappropriation action involving blockchain technology.
