David Rapp-Kirshner represents companies of all stages and sizes in high-stakes trade secret, copyright, trademark and business tort litigations and disputes, and counsels clients on IP protections in the age of AI.

David Rapp-Kirshner is a Managing Associate in the Intellectual Property Litigation Department at Orrick, focusing on complex trade secret, copyright, trademark and business torts disputes. He represents clients in high-stakes, bet-the-company litigation across a range of industries, including tech, biotech, software as a service, supercomputing, semiconductors, consumer goods and more. In addition to his litigation practice, David counsels companies of all stages and sizes on intellectual property protections and enjoys working hand-in-hand with clients to navigate complex legal issues.

David earned his J.D. from New York University School of Law, where he served as an executive editor on Moot Court Board, earned Order of the Barristers honors, and externed with the Civil Division of the U.S. Attorneys' Office for the Easter District of New York. In addition to his billable work, David enjoys a robust pro bono practice with a focus on criminal justice work. David also frequently participates in law school outreach and has given talks at Stanford Law School and UC Berkeley School of Law.
