Emily L. Zheng is a Boston intellectual property litigator and a former federal court clerk, focusing on copyright, trademark, trade secret and other technology-related disputes.
Prior to joining Orrick, Emily served as a law clerk to the Honorable Denise J. Casper of the United States District Court for the District of Massachusetts and to the Honorable O. Rogieree Thompson of the United States Court of Appeals for the First Circuit. In that role, Emily acquired significant legal writing and research experience, as well as insight into effective courtroom advocacy.
Emily has assisted life sciences and technology clients in various adversarial contexts, including federal and state court litigation, arbitration, internal investigations and responses to government subpoenas. These matters involved trade secret misappropriation, copyright and trademark disputes, computer fraud claims, and claims of falsified scientific data.
Emily graduated magna cum laude from Boston University School of Law. In law school, Emily was a student advocate in the BU-MIT Technology Law Clinic, where she advised BU and MIT students of all levels on cutting-edge legal issues, including criminal and civil liability related to web-scraping and intellectual property concerns associated with generative AI algorithms. She also contributed to a summary judgment brief in support of a FOIA request against the CIA. Separately, Emily prepared a trademark letter of protest for a pro bono client, objecting to an attempt to register a common political slogan, under the supervision of Professor Stacey Dogan.
