Orrick Favorably Settles Patent Infringement Suit Against Audible Magic

Orrick obtained a summary judgment ruling in favor of its client, Audible Magic, clearing Audible Magic of patent infringement claims by Blue Spike, LLC. The suit alleged that Audible Magic, known for its digital fingerprinting and automated content recognition (ACR) solutions, infringed certain of Blue Spike’s patents with respect to Audible Magic's audio recognition technology.

In addition to the ruling on the merits, Orrick helped Audible Magic and 19 of its customers reach a favorable settlement, securing an acknowledgment from Blue Spike that Audible Magic’s products do not infringe any of Blue Spike’s patents. Blue Spike also agreed that it will not bring any further suits against Audible Magic. The suit was dismissed by U.S. District Judge Robert W. Schroeder III of the Eastern District of Texas on July 12th.
