U.S. Supreme Court Amicus Brief in Potentially Landmark Affirmative Action Case

A team of advocacy attorneys is preparing a brief that will be filed with the U.S. Supreme Court in a potentially landmark affirmative action case, Fisher v. University of Texas at Austin.  The Orrick brief which is being co-counseled with our legal services organization partner, Lawyers Committee for Civil Rights, will be filed in support of more than twenty student groups in California highlighting California’s experience under Proposition 209 (which amended the State constitution to prohibit state government from considering race, sex or ethnicity in the areas of, among other things, public education), and to show the inefficacy of race-neutral measures at achieving diversity. 

The team consists of San Francisco antitrust partner Bob Rosenfeld, San Francisco litigation contract associate Jason Wu, Silicon Valley intellectual property counsel Monte Cooper, Seattle managing securities litigation and regulatory enforcement managing associate David Keenan and Washington D.C. litigation associate Nick Lenning.
