Professional regulatory provisions for Lawyers admitted in Germany are the Federal Lawyers’ Regulation (Bundesrechtsanwaltsordnung - BRAO), the Specialist Lawyers’ Regulation (Fachanwaltsordnung - FAO), the Lawyers’ Fees Act (Gesetz über die Vergütung von Rechtsanwältinnen und Rechtsanwälten - RVG), the Rules of professional practice (Berufsordnung der Rechtsanwälte - BORA), the Charter of core principles of the European legal profession and Code of Conduct for European lawyers (CCBE) and the Law pertaining to the professional law regulating the legal profession (Gesetz über die Tätigkeit europäischer Rechtsanwälte in Deutschland - EuRAG), respectively the regulation regarding the implementation of § 206 of the Federal Lawyers’ Act for lawyers from non-european countries. Professional regulatory provisions for public certified accountants  in Germany are the Public Account Act (Wirtschaftsprüferordnung - WPO), the Professional Charter for Accountants/Chartered Accountants (Berufssatzung für Wirtschaftsprüfer und vereidigte Buchprüfer - BS WP/vBP), the Rules on Quality Control (Satzung für Qualitätskontrolle), the Sealing Regulation (Siegelverordnung -Siegel-VO) and the Regulation for the Insurance of Professional Liability of Accountants (Wirtschaftsprüfer-Berufshaftpflichtverordnung - WPBHV).

Professional Liability Insurance

Our professional liability insurer is ERGO Versicherung AG, Victoriaplatz 1, 40198 Düsseldorf. The insurance covers worldwide activity in connection with providing legal advice on and services in connection with domestic and foreign law, representation in domestic and foreign courts, as well as legal actions in domestic and foreign courts. The aforementioned insurance coverage applies only to German offices of Orrick, Herrington & Sutcliffe LLP and the professionals insured via ERGO Versicherungs AG.

In Addition, all professionals working in our German offices are covered by professional liability insurance with MPC Insurance, Ltd. The liability insurance covers worldwide professional responsibilities acts or omissions.

Consumer Dispute Resolution

We are not obliged to use and we will not make use of Alternative Dispute Resolution entities within the meaning of the Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz – VSBG) to resolve disputes with consumers.
