AI Regulatory Landscape: Three Things to Know

1. What's Happening with U.S. State AI Laws?

Most U.S. state AI laws target specific harms like deepfakes and CSAM. Recently, the State of Texas enacted TRAIGA, which includes a comprehensive suite of AI requirements ranging from prohibiting intentionally manipulative and harmful AI to regulating government use of AI. In addition, the State of New York has addressed AI companion chatbots with disclosure and suicidal ideation response requirements.

2. Will Federal AI Regulation Override State Laws?

The U.S. Senate proposed a moratorium on state-level AI law enforcement but ultimately rejected it. This maintains the current patchwork approach, with 150+ U.S. state AI laws now on the books.

3. What Is the General-Purpose AI Code of Practice?

In July, the European Commission published the General-Purpose AI Code of Practice to help companies comply with the EU AI Act’s legal obligations on safety, transparency and copyright of general-purpose AI models. General-Purpose AI Model obligations under the EU AI Act will be effective August 2, 2025.

California Employment AI Regulation

California's SB7 would impose additional requirements and limitations on employer use of AI for employment-related decisions.

New York's RAISE Act

The RAISE Act, “Responsible AI Safety and Education Act” (SB6953B) is currently on the governor's desk. This landmark legislation would prohibit large developers from deploying frontier models that create unreasonable risk of critical harm and require written safety and security protocols.
