A New Frontier for ESG: Responsible Sales

Orrick’s Carolyn Frantz and Betsy Popken have authored an article in Bloomberg Law that provides practical guidance to companies on responsible sales policies with ESG considerations in mind. They explain that responsible sales, where a corporation decides whether to do business with a particular customer based on its alignment with corporate values, are growing in prominence.

The authors also note that, “Given the increasing intensity of interest in corporate values, however, companies should be realistic about the chance that they will escape significant scrutiny,” adding that many, “companies are considering whether and how to formalize their approaches, much as digital platforms have already formalized their approach to content moderation.”
