Cybersecurity Provisions in Trade Agreements: The State of the Art

Harry Clark, Chair of Orrick’s International Trade & Compliance Group, co-authored an article with Chimène I. Keitner, Professor of International Law at UC Hastings College of the Law, on digital trade and cybersecurity provisions in multilateral trade agreements. Harry and Chimène examine how growing concerns about cybersecurity and the perceived risks posed by foreign technology and foreign control over data are addressed in current trade treaties. They take a look at the implications of these treaties on national security and assess the treaties’ effectiveness at resolving cybersecurity and digital trade challenges. Chimène, an authority on international law and civil litigation, previously served as Orrick's Scholar-in-Residence.
