Harry Clark Weighs in on CFIUS Resistance to Sale of Semiconductor Technology to China

​Harry Clark, Chair of Orrick’s International Trade & Compliance Group in Washington, D.C., recently spoke with Bloomberg regarding reported resistance by the Committee on Foreign Investment in the United States (CFIUS) to the sale of Royal Philips NV’s Lumileds lighting business to a group of investors led by China’s GO Scale Capital Ltd. The sale includes semiconductor technology, which has become an acutely controversial subject of CFIUS foreign investment screening.

Harry noted, “Many say while one individual deal may not be a problem, there is an aggregate issue.” He continued​, “Isn't there a tipping point? There's no easy answer to that question.”
