Intellectual property partner Gabe Ramsey was interviewed by Law360 recently about the broad cybersecurity framework proposed by the Obama administration.
According to Ramsey, the framework is likely to be used in private matters to establish the reasonableness or unreasonableness of a company's existing data security strategy.
“In class actions over data security and fallouts from breaches, somebody is going to the framework as a resource. It's not specific enough to be determinative, but private litigants as well as regulators can latch on to it and use it as a point of reference,” he said.
