One concrete way to maintain a focus on a potential appeal is to call in an attorney who specializes in appellate issues early in the trial court proceedings, said Loeb.

"When you have a big-ticket case … more and more you're involving appellate counsel early on," said Loeb. "It adds a lot of value and saves a lot of problems later on."

Filing a document with the court can also be a way to codify a sidebar discussion that may have happened out of earshot of the court reporter, he added.
