This article, about the Professional Insurance Agents (PIA) of New York filing an ethics complaint over controversial ads published by law firm Jacob & Meyers LLP after Superstorm Sandy, quotes insurance of counsel Marc Mayerson.
Mayerson said that the PIA may be technically correct to object to the implication that insurance agents made an error, but whether the ad is actually misleading is an open question.
"It does not seem to me that this is a serious legal advertising violation or breach of legal ethics," Mayerson said. "The PIA's complaint seems more a complaint about supposed injury to their reputation than it is a misleading advertisement to potential law firm clients."
