This article, about a consumer protection class action suit filed against Nvidia Corp., quotes securities litigation & regulatory enforcement partner Robert Varian, who served as defense counsel, on the judge’s decision to dismiss majority of the claims.
Varian said the ruling effectively ended the case, and validated and underscored strategies that could be employed to defeat similar lawsuits. “Most important, the decision will provide manufacturers of chips and other computer components with ammunition to defeat the panoply of claims typically asserted in consumer class actions. It also restricts the ability of class representatives to assert broad claims based on products that they did not themselves purchase,” Varian said.
