Congratulations to our partner Josh Rosenkranz on being named a 2022 “Litigator of the Year” finalist by American Lawyer. American Lawyer has twice before recognized Josh as Litigator of Year.
This award recognizes results between January 2021 and April 2022. During that period, Josh secured massive wins for our clients, in courts around the country, including the U.S. Supreme Court.
For Johnson & Johnson, he secured the first ruling to recognize that talc litigation claims are grounded in junk science, leading the New Jersey appeals court to reverse a $117 million verdict against our client. He followed that up last month by engineering another reversal for J&J in New York, where a state appeals court overturned a $120 million judgment (Josh led a team that previously had helped reduce the original verdict from $325 million to $120 million). These decisions not only wiped out massive judgments, but established precedent supporting J&J’s central legal position in hundreds of similar cases pending across the country.
Josh also persuaded the Federal Circuit to overturn a $1.2+ billion patent infringement judgment against Gilead’s Kite Pharma unit. This win built upon another victory that Josh scored for Gilead which overturned a $2.5 billion judgment, both involving an important validity defense to infringement of patents in the biotech field. Underscoring the importance of the case, the Federal Circuit chose the appeal as the first case to be argued in person since oral arguments went virtual at the start of the pandemic.
In a U.S. Supreme Court win with broad implications for copyright law, he persuaded the justices that a copyright cannot be invalidated simply because the owner made an honest legal mistake in a registration form. This overturning a Ninth Circuit opinion and vindicating our client Unicolors in its battle with H&M.
The winners will be announced at The American Lawyer’s Industry Awards on November 10.
