Shani advises clients on a wide variety of environmental issues, including including site investigation and remediation, voluntary cleanup programs, Comprehensive Environmental Response, Compensation, and Liability Act liability, air quality, wetlands, National Environmental Policy Act reviews, state and federal protected species, National Historic Preservation Act consultation, wastewater and stormwater discharge, hazardous waste management, toxic tort issues, drinking water protection and environmental permitting.
In her practice, Shani advises clients in the transactional context, assisting clients in identifying, quantifying, and allocating environmental liabilities that arise in energy, business, and real estate transactions. She drafts and negotiates the environmental terms in purchase and sale agreements, lease agreements, and other contracts. Shani also provides regulatory counseling and representation, helping clients to comply with state and federal environmental regulations, representing clients in state and federal enforcements matters, drafting comments on proposed regulations, and drafting petitions to challenge final rules.
Shani has made a strong commitment to pro bono matters. She has represented a client in a CERCLA enforcement action, worked with clients to obtain conservation easements, and drafted an amicus brief opposing the use of the Freedom of Information Act to obtain government scientists’ internal deliberations. She also has represented a client in seeking DNA testing to challenge his criminal conviction.
