Daily Journal Names Orrick Partner Brian Goldman to Top 40 Under 40 List

Congratulations to Brian Goldman on his selection to the Daily Journal’s 2018 Top 40 Under 40 list. In a profile of Brian, the Daily Journal noted Brian’s emergence as a “leader of the elite West Coast federal appellate bar.” In only four years of private practice, he has amassed an impressive record of precedent-setting victories in high-stakes cases on appeal for clients as diverse as global technology companies like Microsoft, local governments, and individuals fighting deportation orders. Most recently, Brian was the lead brief-writer on the Orrick team that represented James Dimaya before the U.S. Supreme Court, which in a 5-4 opinion (with Justice Neil Gorsuch casting the deciding vote) struck down a federal law that virtually guaranteed the deportation of non-citizens deemed to have committed “crimes of violence.”

The profile also highlighted Brian’s role in a precedent-setting victory for Facebook in the Ninth Circuit, a decision which has been cited in a number of high-profile Computer Fraud and Abuse Act cases since. Given that the law was passed in 1986, Brian explained to the Daily Journal that “there isn’t a perfect answer to how the law applies” to questions involving modern technology.  It’s these types of challenging cases that excite Brian the most, he told the Daily Journal, adding that the “absence of a crystal clear answer is the greatest opportunity for a really creative legal argument” and to “flex all the muscles appellate lawyers like to flex.”
