Separate Orrick trial team wins for clients Boiron and SpaceX earned spots on the Daily Journal Top Defense Verdicts of 2016 in California. The list recognizes the top ten defense victories that had a major impact on individuals, companies, industries and society, highlighting trial attorneys for demonstrating exceptional courtroom skills.
In the Boiron case, an Orrick team led by partner Christina Sarchio successfully defended the world’s leading manufacturer of homeopathic drugs in a rare class action lawsuit to go to trial. The plaintiffs alleged that France-based Boiron had misrepresented the health benefits of Oscillococcinum, the company’s leading flu-relief drug, under California’s Unfair Competition Law and Consumer Legal Remedies Act. The Daily Journal observed that Orrick faced a “daunting task” defending Boiron, observing that the allegations “essentially put the homeopathic drug industry itself on trial.” Describing the win, the publication said: “Christina Guerola Sarchio and her client had a good answer to the plaintiffs’ claims.”
After hearing arguments from both sides, a Los Angeles jury in June 2016 took only two hours before reaching its verdict in Boiron’s favor. “The client was tremendously relieved and grateful,” Christina told the Daily Journal.
In addition to Christina, the Orrick team included partner Valerie Goo and associate Elliott Henry.
In the SpaceX case, partner Lynne Hermle successfully defended Elon Musk’s space exploration company against an $8 million gender discrimination and retaliation suit brought by now-former employee Zhoei Teasley. A Los Angeles jury rejected the plaintiff’s claims entirely in a verdict returned in October, prompting the Daily Journal to describe Lynne as “perhaps the most feared employment defense attorney in California.” In addition to Lynne, partner Julia Riechert was a key member of the trial team.The recognition is the latest for both Lynne and Christina, as well as the firm’s overall litigation practice. Among other recent accolades, Orrick was named The Recorder’s Litigation and Employment Departments of the Year in 2016.
