This article, about Ambac and MBIA Insurance Corp. seeking a reversal of two lower court rulings denying jury trials for the companies' fraud claims against Credit Suisse over insurance payments involving mortgage-backed securities, quotes commercial litigation partner John Ansbro, counsel for Credit Suisse.
"The key question is: [Do the complaints] challenge the validity of the contract? And they don't," Credit Suisse attorney Ansbro said.
Ansbro also argued that the insurance policy agreement couldn't be wrongly unwound and that the companies were sophisticated parties that knew what they were getting into.
