White-collar enforcement dropped off under the business-friendly approach of the Trump administration, but activity is poised to pick up substantially in the Biden administration. The Department of Justice and the Securities and Exchange Commission are expected to expand investigations, prosecutions, and enforcement actions, particularly in financial services, including AML and sanctions, and environmental justice. And with the Democrats in control of both houses of Congress, the prospects for investigations that put banks and investment firms in the hot seat are much higher.
