Josh is a partner in Orrick’s Intellectual Property Group and an experienced trial lawyer focusing on high-stakes patent infringement, trade secret, and technology disputes in U.S. district courts, the ITC, and before the Patent and Trademark Office.  

Josh is well known for his ability to deftly put on and cross technical expert and fact witnesses.  He has also served as lead counsel through Final Written Decision in multiple inter partes reviews. 

Josh has litigated and advised on patents and technology disputes covering a wide range of fields, including electronic devices such as power converters; processor architecture, fabrication, and packaging; networking and telecommunications technologies such as routers, switches, and VoIP; computer software and cybersecurity; AR/VR and media technologies' logistics and robotics systems; transportation and trucking technology; and medical devices such as glucose monitors and cardiac defibrillators.  

Before joining Orrick, Josh was an IP litigation partner at Kirkland & Ellis LLP and an IP litigation attorney at Irell & Manella LLP.

  • Josh regularly publishes and speaks on patent litigation and emerging technology issues, including artificial intelligence and patent litigation strategy. His work has appeared in Law360, Bloomberg Law, and the Stanford Technology Law Review, where his article received a Burton Award for Distinguished Legal Writing

    • Obtained a complete defense verdict (no infringement, all asserted claims invalid) for a networking equipment provider in bet-the-company patent litigation in the Eastern District of Texas.
    • Achieved favorable resolutions defending a social networking company in patent litigations involving VoIP, AR/VR, and video compression technologies, including by successfully transferring venue from the Western District of Texas and pursuing multiple IPRs through oral argument.
    • Defended an electronics manufacturer in an ITC investigation against a major competitor, resulting in a favorable Commission Opinion.
    • Represented a logistics technology company as complainant in an ITC trial and as plaintiff in a related arbitration trial.
    • Represented a medical device company as respondent in an ITC investigation against a primary competitor, resolving the matter favorably following trial.
    • Obtained summary judgment and attorneys’ fees defending a consumer products company in patent litigation.
    • Obtained a complete defense verdict for a networking technology company in a dispute over computer security patents, recognized by The Daily Journal as a Top Defense Verdict of 2018.
    • Represented patent owners in disputes related to computer processor architecture, semiconductor packaging, and media technologies.
    • Defended companies in patent disputes involving wireless SEPs, computer processor architecture, robotics systems, and networking technology.
    • Represented plaintiffs in trade secret matters covering healthcare technologies, including pharmacy management software and continuous glucose monitors.
    • Represented plaintiffs and defendants in multiple patent licensing disputes.
