Please join Orrick partner Scott Morvillo and expert practitioners at PLI's Defending Immigration Removal Proceedings 2020.

With the Administration and the Department of Homeland Security focused on enforcement and deportation initiatives, non-citizens facing removal are in need of competent and knowledgeable representation. In response to the acute need for trained attorneys to defend the record number of immigrants facing removal, prominent members of the bar and bench have called for more pro bono work to be done to fill the gap. At this program, expert practitioners will provide a comprehensive, nuts and bolts overview of potential avenues for relief and best practices for defending immigrants facing removal proceedings.

Scott Morvillo will be speaking on the panel, "Cancellation of Removal and Representing the Criminal Defendant in Immigration Removal Proceedings," which will explore:

  • Cancellation of removal for non-lawful permanent residents, how to establish exceptional/extremely unusual hardship
  • Definition of conviction under INA 101(a)(48)(A)
  • Inadmissible vs. removable – what is the distinction and how does it impact your client’s case?
  • Cancellation of removal for lawful permanent residents, how to establish eligibility
  • Definition of aggravated felony, is relief still available?
  • How to pursue post-conviction remedies
  • Intersection with public charge rule
