Frequently Asked Questions

UK: Do NDAs last forever under UK law?

There is no default expiration term for non-disclosure agreements under UK law. Some NDAs have a specific contractual term (usually between 2 and 5 years), whereas others have an indefinite term. In practice, confidentiality restrictions are unlikely to be enforced by UK courts if they relate to information that is no longer confidential (e.g., the information has become publicly available or has lost its commercial value due to the passing of time).
