Doug Mintz, is a first call for energy, commodities and public finance restructuring.  

Doug has deep experience representing lenders, debtors and official and ad hoc committees. He works primarily with bank and hedge fund investors and co-leads Orrick’s hedge fund client initiative.

Chambers USA rates him in Band 3, calling him “a shining star . . . able to apply both a legal mindset and a businessperson’s mindset to distressed situations.” Doug is also recognized by Legal 500 as an “excellent performer” for his work in both Municipal Bankruptcy and Corporate Restructuring.

Prior to joining Orrick, Doug was special counsel at Cadwalader, where he was best known for his representation of the United States Treasury in the bankruptcies of both General Motors and Chrysler (M&A Advisor’s Magnus Deal of the Year). Treasury also retained Doug in the restructuring of several financial institutions.

Doug is currently representing an off shore drilling company and bondholders in several distressed energy and infrastructure situations. 

  • Doug specializes in the following:

    • Municipal bankruptcies and restructurings: Doug has represented bondholders in several Chapter 9 bankruptcies including the City of Detroit and Jefferson County, Alabama, and has consulted with several municipalities regarding their financial concerns. Doug is also advising a number of investors regarding the restructuring of Puerto Rico’s finances including a group of bondholders with respect to a Puerto Rico public corporation. Doug has also advised tribal lenders and borrowers.
    • Energy, Infrastructure and Commodities: Doug focuses largely on restructurings in these sectors. He has represented debtors such as Mirant and LyondellBasell and creditors in cases such as EFH, Indiana Toll Road and other out-of-court commodities and energy matters.  He is currently representing a deepwater offshore drilling company. Doug has also represented lenders to Chesapeake Energy and bondholders of numerous credits. 

    Doug typically represents lenders at both hedge funds and banks.

    • Hedge Funds: Doug has worked with a long list of hedge funds on matters such as Detroit, Puerto Rico, Caesars, Verso/NewPage and Zohar.
    • Lender representations: Doug has represented the agents and lenders in numerous high-profile matters including Indiana Toll Road, Genco, Eagle Bulk, Chrysler, General Motors, Contec, Target Media, LandSource and Station Casinos. Among other things, Doug has played a key role in some of the largest DIP financings ever, including General Motors, Lyondell and Chrysler and helped the US Treasury develop the innovative sale concepts executed in the General Motors and Chrysler bankruptcies.
    • Financials, derivatives and safe harbors: Doug has developed extensive knowledge regarding the close out of safe harbored derivatives such as swaps, repos and securities contracts. He has also helped structure many bankruptcy remote entities.
    • Litigation. Doug also specializes in bankruptcy litigation and works with Orrick’s outstanding litigators on high stakes litigation. He is currently representing a large investment fund in decisive fraudulent transfer litigation.
