Thomas's practice sits at the intersections of two of his passions: legal advocacy and data. Prior to joining Orrick, Thomas served as a law clerk for Justice Elena Kagan of the U.S Supreme Court and Judge Merrick B. Garland of the U.S. Court of Appeals for the D.C. Circuit. Ben Au Partner

Ben’s diverse practice focuses on disputes where an understanding of technology and business is essential. Ben’s civil litigation practice includes trade secret misappropriation, breach of contract, and funder / founder disputes, through arbitration and trial and on appeal. Ben also has extensive experience in government enforcement actions before the SEC and FTC, as well as federal criminal matters ranging from fraud to FCPA to export controls. He has also conducted numerous internal investigations on behalf of corporate clients. Clients praise Ben’s understanding of the tech ecosystem, responsiveness, and practical, solutions-oriented business judgment.

Ben is committed to impacting his community and maintains an active pro bono practice, including representation and collaboration with the ACLU, National Association of Criminal Defense Lawyers, Asian Americans Advancing Justice, Electronic Frontier Foundation, and Equality California, on issues ranging from religious freedom, school integration, reproductive rights, privacy from government surveillance, and the right for same-sex couples to marry.

Ben currently serves on the Board of Directors of 826LA, a non-profit organization providing literacy and writing programs for children in underserved areas of Los Angeles. Since 2018, Ben has served on the Board of Directors for the National Association of Criminal Defense Lawyers. He currently co-chairs its White-Collar Crime Committee and is the vice-chair of its Ninth Circuit Amicus Committee. Ben previously served on the Yale Law School Association Executive Committee, representing Northern and Southern California. The judges of the United States Court of Appeal for the Ninth Circuit appointed Ben to serve as an appellate lawyer representative to the court.

John Lu Partner

Primary Focus & Experience

Dr. Lu’s practice focuses on patent, trade secrets, and life sciences litigation. He has represented clients in matters involving patent infringement, U.S.-China trade secret misappropriation, biosimilars, ANDA litigation, and licensing disputes. He also represents clients in connection with proceedings before the Patent Trial and Appeal Board. His clients have included Genentech, Tris Pharma, Rosenberger, and Natera.

Recognition & Accomplishments

Dr. Lu has been on the editorial advisory board for Law360 Life Science publications and was named to Benchmark Litigation’s “40 and Under Hot List,” which honors the achievements of the nation’s most accomplished litigators under 40. He was also named to the Southern California Rising Stars list by Super Lawyers.

Dr. Lu has authored a number of publications, including: “Thryv: opposing policies in the Supreme Court,” World Intellectual Property Review (June 5, 2020); “The Growth of Online Universities: How to Solve the Accreditation Dilemma, Protect Students, and Expand Access to Higher Education,” a chapter in “Education and Social Media: Toward a Digital Future,” MIT Press (2016); “Senate Gridlock Causes En Banc Uncertainty,” and “Intellectual Property Special Report,” The Recorder (July 15, 2013); and “Promotion and Market Share in the Proton Pump Inhibitor Market: A Case Study,” Journal of Pharmaceutical Marketing & Management, Volume 17, Issue 3, 39-59 (2007).

Dr. Lu is the chair of the board of directors for Asian Pacific American Dispute Resolution Center (APADRC), a nonprofit organization. He was also a Fellow of the Leadership Council on Legal Diversity.

Prior to private practice, Dr. Lu was a law clerk to the Honorable William Alsup of the U.S. District Court for the Northern District of California.

Dr. Lu received his J.D. from Yale Law School, where he was Notes Editor of the Yale Law Journal and Executive Editor of the Yale Journal of Law & Technology. While in law school, he was an extern for the Honorable John T. Noonan of the U.S. Court of Appeals for the Ninth Circuit, and an intern for the U.S. Attorney’s Office for the District of Connecticut.

Prior to law school, Dr. Lu earned his Doctor of Pharmacy, with highest distinction, from the University of North Carolina, and worked in pharmaceutical marketing.

Johannes Hsu Senior Associate

Johannes's practice focuses on patent litigation, especially in the fields of electronics, circuits, computer and network systems, software, and telecommunications. He has litigated in district courts, the Patent Trial and Appeal Board, and the U.S. International Trade Commission. He also leverages his technical and operational experience in data-privacy and data-security matters.

Before joining Orrick, Johannes clerked for the Honorable R. Gary Klausner in the Central District of California. He assisted Judge Klausner on a wide variety of civil matters. In particular, he worked on many intellectual-property disputes involving patents, trademarks, copyrights, and trade secrets. Johannes began his legal career primarily as a patent prosecutor at one of the largest intellectual-property boutique firms in the United States.

Before becoming an attorney, Johannes worked for over 20 years as an engineer in high-tech and aerospace industries. He held increasing responsibilities and was last a manager and a senior principal engineer at one of the top two fabless-semiconductor companies in the world. His work in those positions had a direct and significant impact on virtually every chip of a one-billion-dollar product line.

A technical leader and a functional manager, he interacted regularly with upper management in engineering and marketing and worked closely with cross-disciplinary teams. His substantial engineering experience encompasses a wide array of technologies, from communication systems, digital-security systems, to hardware and embedded-software design. In addition to developing digital-security technologies, Johannes also set operational security policies for his engineering organization and developed a secure infrastructure which he led through a successful third-party audit.
