Barry Levin Partner

San Francisco; New York

Barry is known in the market as “one of the most accomplished litigators,” “very effective in pursuing compelling themes and tearing down witnesses with polite cross-examination” (2017 Benchmark Litigation), and as "a real seasoned veteran of high-stakes litigation" (2020 Chambers USA). Barry has also been commended by his peers as a "fabulous lawyer" who is "very well regarded and really knows the area" (2016 Chambers USA). 

Barry has broad first chair experience in trial and arbitration, ranging from trial counsel for Johns-Manville Corporation in its coverage litigation involving asbestos-related bodily injury claims to successful domestic and international arbitrations on behalf of financial institutions, hospitals, and hospitality companies.  

Over the past 8 years, Barry has developed extensive experience in issues arising out of the financial crisis, including a range of issues relating to mortgage backed securities and lending practices.

He is a frequent lecturer in the area of litigation, insurance coverage and law firm management. Prior to joining Orrick, Barry was a shareholder at Heller Ehrman LLP.

Melissa Levin Managing Associate

Melissa's practice focuses on privacy, online safety, content moderation, and cybersecurity, along with a wide array of commercial disputes.  She has defended and advised one of the largest technology companies in the world for multiple years against claims challenging aspects of its online services, including product design and content moderation decisions.  Her teams help their clients develop creative and effective legal strategies, not only to defend against specific lawsuits, but also to prepare for future legal risk. 

Melissa has also advised multiple clients responding to government investigations, including by the FTC. 

Additionally, Melissa maintains an advisory practice, working with her teams to provide recommendations and risk analyses to various clients on their online terms and policies, content moderation practices, online safety, and issues related to Section 230 of the Communications Decency Act.

Melissa also maintains a pro bono practice. Among other matters, Melissa is currently representing multiple members of a Honduran family seeking various forms of immigration relief.

Vanessa Liborio Partner

Geneva

Vanessa is “a leading arbitration practitioner…well known for her consistently excellent dispute resolution work” (Who’s Who Legal: Arbitration), and acts as counsel in international arbitration proceedings before the ICC, LCIA, the Swiss Arbitration Centre and other international fora and subject to a variety of procedural and substantive laws (including English, French, Italian, Qatari, New York, Mexican, Swiss and Tunisian law). Vanessa's experience spans a variety of industries including construction, life sciences, food and beverages, financial services, insurance and aviation. Most recently, Vanessa has conducted an arbitration on behalf of a sub-contractor involved in the construction of part of an international airport and was successful in representing a Swiss not-for-profit foundation supporting advanced clinical research in rare pediatric diseases. 

Described by clients as an "excellent" lawyer who delivers "very high-quality legal services" (Legal 500), Vanessa has also represented parties in setting aside proceedings before the Swiss Supreme Court and regularly acts as party-appointed arbitrator, sole arbitrator of chair in arbitrations worldwide.

Vanessa serves as a member of the ICC's Commission on Arbitration & ADR and in addition to her activities in the field of arbitration, Vanessa advises on export control regulations and economic sanctions administered by the U.S., the European Union and Switzerland, including matters relating to customs regulations, the Foreign Corrupt Practices Act, anti-money laundering rules and anti-boycott requirements and regularly provides advice to clients on Swiss substantive law, particularly in contract law.

David Litterine-Kaufman Partner

New York

David is a partner in Orrick's Complex Litigation and Dispute Resolution Practice Group based in New York and co-head of Orrick's Bankruptcy Litigation Working Group. His practice focuses on representing lenders, underwriters, and large public and private companies in financial disputes throughout the litigation process, from pre-litigation dispute resolution to success at trial.

David has litigated high-stakes bench and jury trials and pretrial proceedings involving nine-figure secured claims in bankruptcy, multi-billion dollar securities offerings, complex long-term supply contracts, and valuable trademarks.

David also has years of experience litigating distressed asset and syndicated loan trades, contract disputes, and residential mortgage-backed securities issuances for both plaintiffs and defendants. David's background in computer science and mathematics allows him to quickly master complex financial transactions and craft effective litigation strategies for his clients.

Before joining Orrick, David was an associate at Cravath, Swaine & Moore LLP.

Catherine Y. Lui Partner

San Francisco

Cathy also engages in complex commercial litigation including employee mobility, breach of contract, and fraud cases. Her matters are often high-profile and industry-changing. Cathy's practice also includes trade secrets investigations as well as counseling on joint ventures, mergers and acquisitions, third-party vendor relationships, and emerging technology to help minimize the risk to companies. Cathy has significant experience in actions arising from the Defend Trade Secrets Act (DTSA), which created the first federal civil misappropriation of trade secrets claim in May 2016. Cathy has helped shape DTSA law on behalf of her clients through her involvement in some of the earliest DTSA litigation. Many of her trade secrets cases involve parallel criminal proceedings.

For her achievements, Legal 500 recognized Cathy as a "Leading Lawyer" in trade secrets in 2024 and 2025. The National Asian Pacific American Bar Association also honored Cathy as a 2019 Best Lawyer Under 40. This annual list recognizes individuals within the APA community who have achieved prominence or distinction in their field and demonstrated a strong commitment to the APA community or civic affairs.

Cathy also regularly speaks and writes about trade secrets issues. She previously served as the Co-Vice Chair of the Trade Secrets Interest Group of the California Lawyers Association's (formerly of the California State Bar) Intellectual Property Section and she writes an annual column about trade secret hot topics in the CLA's "New Matter" publication.

Cathy is very active within the firm and her community. Cathy previously served as the Hiring Partner for the San Francisco office. Orrick selected Cathy to serve as the firm's 2020 Fellow for the Leadership Council on Legal Diversity, and Cathy previously served as the Co-Chair of the Asian American Bar Association's Judiciary Committee, which is focused on increasing representation on the bench.

Cathy also maintains an active pro bono practice. Cathy's dedication to pro bono service was demonstrated by her work in an asylum merits hearing representing a Salvadoran religious activist persecuted by gangs in El Salvador. For her work on this matter, the Lawyers Committee for Civil Rights honored Cathy with the Father Cuchulain Moriarity Award. In addition, the Justice & Diversity Center of the Bar Association of San Francisco recognized Cathy as an Outstanding Volunteer in Public Service in 2014 through 2020 for her work with helping homeless clients remove outstanding warrants barring them from access to housing and employment.
