In his previous role at Orrick, Dick was a partner in the New York office, and a member of the Securities Litigation, Investigations and Enforcement Group. His practice focused on accountants’ liability, securities and commercial litigation, as well as arbitration and international and domestic white-collar criminal law. Dick is now Senior Counsel at Orrick, and while he continues to contribute to the work of those groups, his primary focus is on assisting our pro bono client, the Center for Reproductive Rights.

Dick has been involved in litigation in the state and federal courts of the United States, Europe, Asia and the Americas for more than 40 years. From June 1987 to August 1990, Dick served as Special Representative of the Attorney General, located at the United States Embassy in Rome, Italy. There he represented the Department of Justice in Europe and handled extradition and mutual assistance matters throughout Europe and North Africa, among other duties. In August, 1990, Dick’s contributions to the Administration of Justice in Italy were recognized when he was named “Commendatore al Merito della Republica Italiana”, the Italian Legion of Honor.

Prior to transferring to Rome, Dick served as an Assistant United States Attorney for the Southern District of New York, from January 1980 to June 1987. Dick received numerous commendations for his work in the United States Attorney’s Office, including the Distinguished Service Award from the Department of Justice for his leadership role in the case known as the “Pizza Connection”. Dick has been fluent in Italian since he was awarded an AFS scholarship for the school-year program in Naples, Italy, where he attended Liceo Classico.

Darrell Cafasso 合伙人

Prior to joining Orrick, Darrell served as the Global Head of Litigation and Regulatory Proceedings at Goldman Sachs, where he served as a key advisor to the firm and oversaw litigation, arbitration, and other disputes, as well as regulatory, criminal, and investigative proceedings, affecting Goldman Sachs, its world-wide affiliates, or their employees. In this role, Darrell managed a large international team of lawyers that determined legal strategy for threatened or actual litigations, regulatory and criminal matters and other contentious proceedings, oversaw internal investigations, and advised legal and business constituencies on legal, reputational and regulatory risks and issues involving all businesses of Goldman Sachs including investment banking, global markets, merchant banking, research, trading, lending, M&A, asset and wealth management, and consumer lending. Darrell was responsible for the firm’s most critical litigation and regulatory matters and successfully resolved a number of important matters on behalf of the firm.

Before joining Goldman Sachs in 2018, Darrell was a litigation partner at Sullivan & Cromwell LLP. Most recently, Nick served as co-lead trial counsel to the private credit arm of a global financial company and secured a $100 million trial victory in connection with multiple defaulted loans.

Nicholas also has extensive experience in issues arising out of the financial crisis, including a range of issues relating to residential mortgage backed securities (“RMBS”) and lending practices. He has represented issuers and sponsors of RMBS in fraud and breach of contract cases, as well as federal and state securities actions. Nicholas has defended a global financial institution in connection with two separate trials in the New York Supreme Court.

Marc R. Shapiro 合伙人

Marc represents clients in federal and state court at the trial and appellate levels with a particular focus on class actions, multi-district litigation, and mass joinders. Among Marc’s current engagements, he represents Johns Hopkins University and Teachers Insurance and Annuity Association of America in over a dozen class actions arising out of a data breach of the MOVEit file transfer software; University of Washington in a pandemic-related class action seeking refunds of tuition and fees on behalf of students; ZoomInfo Technologies LLC in a data privacy class action alleging unlawful disclosure of personal information under federal and state laws; Goldman Sachs in a pay and promotion gender discrimination class action; NCAA in concussion and injury-related cases throughout the country; Marathon Oil Corporation in nationwide climate change litigation; and multiple foreign defendants in a class action arising out of allegedly defective drywall.

Recently, Marc successfully prevailed at trial before the Delaware Chancery Court and earned Litigator of the Week recognition by Law.com for defeating claims by Netflix star Julia Haart that she owns half the shares of Elite World Group; secured dismissal of a dozen class actions against the University of California and Santa Clara University brought by students seeking refunds of tuition and fees due to COVID-driven transition to remote instruction; and defeated class certification and secured affirmance on appeal by the Ninth Circuit in an employment discrimination class action against Microsoft.

Marc served as a law clerk to Judge Betty B. Fletcher of the U.S. Court of Appeals for the Ninth Circuit. Prior to joining Orrick, Marc worked as an appellate and post-conviction attorney for the Equal Justice Initiative. In that capacity, he engaged in trial level and appellate representation of clients in both state and federal court, including two cases that were briefed and argued before the United States Supreme Court.
