Clem acts as lead counsel for companies of all sizes across a broad range of industries. He has lead cases dealing with machine learning and AI, medical devices, network security, pharmaceuticals (both Hatch Waxman and competitor cases), video games, battery chemistry, consumer electronics, blockchain and other payments systems, streaming video, ticketing systems, telecommunications, and many more.

Clem has an active trial practice. In 2023 alone, Clem acted as lead counsel for teams that won two jury verdicts, three ITC proceedings, and numerous IPRs and dispositive motions.

Clem has been recognized in the Daily Journal’s list of the top 75 IP Litigators in California. In the latest Chambers USA rankings, clients note he is a “very persuasive advocate who knows the law inside out and is able to get to the heart of the issue very quickly.“ Managing Intellectual Property described him as a “highly respected litigator in the California IP market and beyond.” Intellectual Asset Management’s Patent 1000 notes he is a “commercially savvy first-chair trial lawyer,” a “tenacious, pragmatic litigator who excels at finding innovative solutions,” “one of the best writers anywhere” and a “fantastic negotiator.”

In his commercial litigation practice, Matthew represents clients in federal and state court at the trial and appellate levels. While Matthew routinely assists clients at all stages of the litigation process, through motions practice, discovery, witness preparation, and trial, he has a particular focus on class action defense. Matthew's litigation experience is broad, including data security litigation, commercial and contractual disputes in all industries, shareholder derivative litigation, and class action defense, as well as commercial arbitration. His current engagements include representation of clients facing consumer class actions arising out of a data breach of the MOVEit file transfer software; a social media company facing consumer class actions arising out of a data breach; the University of Washington in a pandemic-related class action seeking refunds of tuition and fees on behalf of students; and a series of litigations over the ownership and control of a social media company.  

In his cybersecurity practice, Matthew counsels clients across the globe through all stages of a privacy or data security incident, navigating the relevant legal regimes, managing the response to and investigation of an incident, and handling any litigation or regulatory investigation resulting from the incident. Lek Regjepaj is involved in public contracts, in particular concession contracts and public-private partnerships for major projects (airport, port, motorway, building, telecommunications). He assists consortiums in the award of these contracts, from the bidding phase to the post-award phase.

He advised the winning consortium for the concession to operate Beauvais-Tillé airport (near Paris), as well as a bidding consortium for a public-private partnership project to finance, design, build, maintain and operate the new headquarters of the Grand Port Maritime de Marseille.

In the field of renewable energy, Lek Regjepaj works alongside the French government (Ministry of Energy, Directorate General for Energy and Climate) on tenders for the construction of offshore wind farms (both installed and floating).

He also advises operators, sponsors and lenders on project development and M&A transactions involving wind and solar assets, as well as in innovative sectors such as biomass, geothermal energy and green fuels.
Lek Regjepaj has also contributed to the revision of contractual terms for public subsidies for deep geothermal energy, on behalf of public and semi-public bodies.

His practice covers all regulatory aspects of activities, whether regulated or not. He has advised telecommunications operators, both wholesale and retail, as well as industrial groups, on the rules applicable to them.

John litigates a wide range of commercial disputes, including financial services litigations involving RMBS, disputes in the wind and solar power industries across a host of contractual issues, construction disputes, long-term take-or-pay and liquidated damages disputes, force majeure, bankruptcy litigation, insurance recovery, and commercial real estate foreclosure. He was also an arbitrator on an ICC International Court of Arbitration panel in a cross-border industrial contract dispute.

COVID-19’s unprecedented global market impact has clients across an array of industries seeking John’s counsel on force majeure and related breach of contract disputes. These include force majeure matters across jurisdictions and industries, including Energy & Infrastructure, Pharmaceuticals, Financial Services, Real Estate, Hospitality, and Retail.

John litigates significant, high stakes matters. For example, in 2017 on behalf of his client Hemlock Semiconductor Corp., in a case of first impression in Michigan, on appeal John won the dismissal of an attempt by a Japanese conglomerate to avoid $1.4 billion in purchase obligations on the theory that alleged acts by the Chinese Government constituted an “act of government” under the parties’ force majeure provision. The Michigan Bar Journal declared it one of the top 10 business cases of 2010-2019. In 2019, one of the very few RMBS actions to be tried, John was trial counsel for Credit Suisse Securities USA in a $700 million dispute in the Supreme Court of New York. At trial he handled the defense expert in the critical area of loan underwriting.
